Terms and privacy
This page explains how to use our services, the limits of our responsibilities, and how we handle user information.
1. Nature of the services
SmartTradePath provides information, education, market analysis, signals, prices, and related tools. Site content alone does not guarantee profit or a financial outcome.
2. Investment disclaimer
Each user is responsible for their decisions to buy, sell, hold, or allocate assets. Financial markets, equities, gold, currencies, and cryptocurrencies may result in the loss of part or all of your capital.
Past returns, trader rankings, and signals do not guarantee future profits. Before making significant decisions, consider your circumstances and, where appropriate, consult a licensed professional.
3. Signals and analysis
Forex, crypto, and Crypto Spot signals and analysis may rely on market data, user opinions, or third-party sources and may be affected by delays, errors, or changing market conditions.
The site does not execute trades in user accounts unless a separate lawful service is provided under an explicit agreement.
4. Prices and live data
Prices may be obtained from Binance, TSETMC, or other data sources. Internet outages, API limits, rate differences, delays, and third-party errors may occur. Always verify the final execution price with the venue where you trade.
5. Instructors, users, and third-party content
Listing an instructor, trader, comment, rating, or user contribution does not confirm their skills, licensing, identity, or performance. Verify significant claims independently.
6. Accounts and security
Users are responsible for protecting their passwords, login codes, and devices. Unauthorized access, attempts to bypass security controls, service disruption, and using another person’s credentials are prohibited.
This provision relates to the prohibition of unauthorized access under Iran’s Computer Crimes Law of 2009 and subsequent applicable regulations.
7. Privacy and user information
The site may process information needed for accounts, sign-in, notifications, security, and service delivery. Information is retained only as required for technical and operational purposes and is not disclosed to unrelated parties without lawful authority or a service-related need.
Where applicable, personal data is handled in accordance with relevant personal data provisions of Iran’s Electronic Commerce Law, including Article 58.
8. Notifications and email
When enabled, the site may send on-site or email notifications about new posts, signals, instructors, or service events. Site administrators can manage these notifications.
9. Content ownership and permitted use
Extensive copying, commercial redistribution, resale, harmful automated extraction, and use of the site’s brand or proprietary content without permission are prohibited unless allowed by law or an explicit license.
10. Limits of liability
To the extent permitted by law, the site accepts no responsibility beyond its legal obligations for losses arising from independent user decisions, market movements, third-party outages, internet disruption, or use contrary to these terms.
Exception: These terms do not exclude liability for fraud, intentional misconduct, or rights that cannot legally be waived. Article 1 of Iran’s Civil Liability Law also establishes liability for harm caused intentionally or negligently.
11. Capital market services
Terms such as investment adviser and portfolio manager have specific definitions and requirements under Iran’s Securities Market Law. General site content should not be treated as a claim of authorization for these activities unless a valid official license is expressly disclosed on the site.
12. Changes to these terms
This text may be updated as services develop or laws change. The version published on this page is the current version.
13. Governing law and interpretation
These terms are interpreted under applicable laws of the Islamic Republic of Iran, including, as relevant, the Electronic Commerce Law of 2003, Computer Crimes Law of 2009, Civil Liability Law of 1960, and Securities Market Law of 2005.
If these terms conflict with mandatory law, the law takes precedence.
